1. General Terms

By engaging Bit Spark for any service, you acknowledge that you have read, understood, and agreed to the terms outlined below. These terms govern all services, including website development, app development, digital marketing, hosting, and related activities.

2. Booking & Payments

  • The booking amount is non-refundable under any circumstances.
  • Once a domain name is registered, it cannot be changed, canceled, or transferred. If you wish to use another domain name, new registration charges will apply.
  • Domain and hosting charges are extra and recurring annually unless mentioned otherwise.
  • All invoices must be paid on or before the due date. Delayed payments may attract late fees or suspension of services.
  • In case of project cancellation initiated by the client, all payments made till date are non-refundable.

3. Project Workflow & Communication

  • You will receive regular updates regarding your project through WhatsApp and email.
  • Clients are required to share all required content (text, images, credentials, etc.) in advance to ensure timely delivery.
  • Any delay in content submission from your side will not be considered a delay from Bit Spark.
  • If you are unresponsive for more than 7 days, the project will be considered inactive and cancelled, and no refund will be issued.
  • Project timelines may vary based on revisions, third-party dependencies, or unforeseen technical challenges. Bit Spark reserves the right to extend deadlines if required.

4. Revisions & Delivery

  • Minor revisions are included as per the selected package. Major design or functionality changes after approval will incur additional costs.
  • Once the project is completed and approved, any future updates or maintenance will be charged additionally.
  • Delivery of the final project will be done only after full payment clearance.

5. Intellectual Property

  • All content, media, or assets provided by the client must be legally owned or licensed. Bit Spark is not responsible for copyright violations arising from client-supplied materials.
  • The developed website/app remains the property of Bit Spark until the full project payment is received.
  • Licensed stock images, fonts, and plugins used during the project are bound by their respective license terms.

6. Hosting, Domains & Renewals

  • Hosting and domain renewals are the client’s responsibility unless covered under a maintenance plan.
  • Bit Spark is not responsible for website downtime, loss of data, or expiration of domain/hosting if renewals are not processed on time.
  • Any migration or transfer to another hosting provider will incur additional technical support charges.

7. App Development & Third-Party Services

  • For mobile app development, publishing on Play Store/App Store may involve additional verification, compliance, or account setup by the client.
  • Bit Spark is not responsible for any delays or rejections from third-party platforms like Google or Apple.
  • APIs or third-party integrations (payment gateways, CRMs, etc.) are governed by their respective providers.

8. Marketing & Communication

  • Bit Spark may use your project screenshots, website link, or testimonial for portfolio and marketing purposes unless explicitly requested otherwise in writing.
  • We may communicate with you through email, WhatsApp, or SMS for updates and promotions. You can opt out anytime by replying “STOP” or clicking unsubscribe.

9. Limitation of Liability

  • Bit Spark will not be liable for any indirect, incidental, or consequential losses arising out of website/app usage, downtime, or technical errors.
  • Technical support is available as per the chosen package. Any post-delivery issue unrelated to our scope may attract additional support fees.

10. Legal & Jurisdiction

  • All disputes are subject to the jurisdiction of Delhi (India).
  • Bit Spark reserves the right to modify these terms at any time without prior notice.
